This bill adds a good faith exception to the exclusionary rule and calls on the NC Supreme Court to overturn State v. Carter, 322 N.C. 709 (1988). Carter held the good faith exclusion did not apply under NC law. Civitas believes the conservative position is that evidence obtained by law enforcement officers acting in good faith under a search warrant should be admitted in a criminal trial, even if the search warrant has a technical defect. Criminal trials in NC courts should operate similarly to criminal trials in federal courts.
