HB 409: Regulation of Accessory Dwelling Units would allow ADUs, sometimes called mother-in-law suites or granny flats, by-right across the state. The bill would remove local regulations that make ADU impractical, such as owner-occupancy requirements, parking minimums, and conditional-use zoning. Local governments would still be allowed to regulate ADUs so long as they do not discourage the development or siting with unnecessary costs and delays.
Residents all over North Carolina face a housing crisis due to a shortage of new homes. Allowing ADUs by right would not be a silver bullet for the housing crisis. However, this is a meaningful reform that will increase the housing supply and property rights in North Carolina. The bill will give more options to families who want to stay together, help seniors with changing needs, and alleviate housing shortages for the workforce.
